အာဂျင်တီးနားတရားရုံးရောက် ရိုဟင်ဂျာအမှုနှင့် ပတ်သက်၍ သဘောထားထုတ်ပြန်ချက်

၁။ ရိုဟင်ဂျာများအပေါ် နည်းလမ်းမျိုးစုံအသုံးပြု၍ အကြမ်းဖက်သတ်ဖြတ်မှု ကျူးလွန်ခဲ့သူများမှာ မြန်မာစစ်တပ်ခေါင်းဆောင်များနှင့် ၎င်းတို့၏လက်အောက်ခံ တပ်ရင်းတပ်ဖွဲ့များသာဖြစ်ပြီး အဆိုပါ ပြစ်မှုများနှင့် လျော်ညီသော ပြစ်ဒဏ်ချမှတ်နိုင်ရေး၊ ကျူးလွန်ခံခဲ့ရသူများအတွက် တရားမျှတမှု ပြန်လည်ရရှိ စေရေးအတွက် နိုင်ငံတကာတရားရုံးများတွင် တရားစွဲဆိုနိုင်ရေး ကြိုးပမ်းမှုမှန်သမျှကို အမျိုးသား ညီညွတ်ရေးအစိုးရအနေဖြင့် ကြိုဆိုထောက်ခံပါသည်။
၂။ ၂၀၁၇ ခုနှစ်၌ ဖြစ်ပွားခဲ့သော ရိုဟင်ဂျာများအပေါ် အကြမ်းဖက်သတ်ဖြတ်မှု ကျူးလွန်ခဲ့သူများမှာ ထိုစဉ်က တရားဝင် ကျင့်သုံးခဲ့သော ၂၀၀၈ ခုနှစ်၊ ဖွဲ့စည်းပုံအခြေခံဥပဒေပုဒ်မ ၂၀ (ခ)၊ (ဂ) အရ မင်းအောင်လှိုင် ဦးဆောင်သည့် မြန်မာစစ်တပ်သာလျှင်ဖြစ်ပြီး ၎င်းတို့ကျူးလွန်ခဲ့သည့် ပြစ်မှု၊ပြစ်ဒဏ်အားလုံးအတွက် ခြွင်းချက်မရှိ တာဝန်ယူ၊ တာဝန်ခံရမည့်သူများမှာ မင်းအောင်လှိုင်နှင့် အပေါင်းအပါများသာဖြစ်သည်။ ထို့ကြောင့် မင်းအောင်လှိုင်နှင့် အပေါင်းအပါများအား UK အခြေစိုက် Burmese Rohingya Organisation UK (BROUK) က အာဂျင်တီးနားတရားရုံးမှတဆင့် တရားစွဲဆိုခြင်း နှင့် ဖမ်းဝရမ်းထုတ်ခြင်းကို ကြိုဆိုပါသည်။
၃။ သို့သော် အာဂျင်တီးနားနိုင်ငံ တရားရုံးက နိုင်ငံတော်သမ္မတဟောင်း ဦးထင်ကျော်နှင့် လက်ရှိနိုင်ငံတော်၏ အတိုင်ပင်ခံ ပုဂ္ဂိုလ်ဒေါ်အောင်ဆန်းစုကြည်တို့ကို လူမျိုးတုံးသတ်ဖြတ်မှု နှင့် စစ်ရာဇဝတ်မှု အမှန်တကယ် ကျူးလွန်ခဲ့သော မင်းအောင်လှိုင်နှင့် အပေါင်းအပါများနည်းတူ တရားခံစာရင်းတွင်ထည့်သွင်း၍ ဖမ်းဝရမ်း ထုတ်ရန် ကြိုးပမ်းနေခြင်းအား မှားယွင်းသောစွပ်စွဲဆောင်ရွက်ချက်အဖြစ် ကျွန်ုပ်တို့ အခိုင်အမာ မှတ်ယူ သောကြောင့် တရားစွဲဆိုထားခြင်းမှ ဖယ်ရှားပေးရန်တောင်းဆိုပါသည်။
၄။ နိုင်ငံတော်သမ္မတဟောင်း ဦးထင်ကျော်နှင့် နိုင်ငံတော်၏ အတိုင်ပင်ခံပုဂ္ဂိုလ် ဒေါ်အောင်ဆန်းစုကြည် တို့သည် ရိုဟင်ဂျာအရေးအတွက် ခိုင်မာကောင်းမွန်၍ ရေရှည်ငြိမ်းချမ်းပြေလည်မည့် အဖြေရရှိ စေရန် “ကိုဖီအာနန်ကော်မရှင်” ဖွဲ့စည်းခြင်းအပါအဝင် နည်းလမ်းအမျိုးမျိုးဖြင့် ကြိုးပမ်းဆောင်ရွက် ခဲ့ကြ ပါသည်။
၅။ အလားတူ အမျိုးသားညီညွတ်ရေးအစိုးရ အနေဖြင့်လည်း “ရိုဟင်ဂျာမူဝါဒ” တရပ် ပြဌာန်း၍ ရိုဟင်ဂျာ ပြည်သူများ တရားမျှတမှု ရရှိရေးနှင့် ပတ်သက်ပြီး တစိုက်မတ်မတ် ဆောင်ရွက်လျက်ရှိပါသည်။
၆။ ယခုကဲ့သို့အခြေအနေတွင် အမျိုးသားညီညွတ်ရေးအစိုးရ၏ ခေါင်းဆောင်တဦးဖြစ်သော နိုင်ငံတော်၏ အတိုင်ပင်ခံပုဂ္ဂိုလ် ဒေါ်အောင်ဆန်းစုကြည်နှင့် သမ္မတဟောင်း ဦးထင်ကျော်တို့ကို အာဂျင်တီးနားတရားရုံးတွင် မှားယွင်းစွာ ထည့်သွင်းတရားစွဲဆိုခြင်းသည် ရိုဟင်ဂျာပြည်သူလူထုနှင့် အခြားပြည်သူလူထုများအကြား နားလည်မှု လွဲမှားခြင်းများ ဖြစ်ပေါ်လာနိုင်ပြီး၊ ရေရှည်ငြိမ်းချမ်းရေး၊ သင့်မြတ်ရေးနှင့် အနာဂတ်ကာလ မြန်မာနိုင်ငံ၏ ဒီမိုကရေစီ ဖော်ဆောင်ရေးကို များစွာအနှောင့်အယှက် အဟန့်အတား ဖြစ်လာနိုင်ပါသည်။
၇။ သို့ပါ၍ အာဂျင်တီးနားတရားရုံးက ပြည်သူ့အစိုးရအဖွဲ့ခေါင်းဆောင်များကို ထည့်သွင်းတရားစွဲဆိုကာ ဖမ်းဝရမ်းထုတ်ရန် ကြိုးပမ်းခြင်းအားဖြင့် မြန်မာနိုင်ငံသားများ အချင်းချင်းအကြား သွေးစည်းညီညွတ်မှုကို ပြိုကွဲစေပြီး၊ စစ်အာဏာရှင်စနစ် အပြီးတိုင်ချုပ်ငြိမ်းစေရေးအတွက်ရွပ်ရွပ်ချွံချွံ တိုက်ပွဲဝင်လျက်ရှိသော နွေဦးတော်လှန်ရေးကို အနှောင့်အယှက်ဖြစ်စေမည်သာမက၊ အကြမ်းဖက်စစ်အာဏာရှင်များကိုသာ အကျိုးကျေးဇူးဖြစ်ထွန်း စေလိမ့်မည် ဖြစ်ပါကြောင်း သဘောထားထုတ်ပြန်အပ်ပါသည်။

Statement on the Rohingya Case at the Argentine Court

1. The perpetrators of the mass atrocities committed against the Rohingya through various violent means are solely the leaders of the Myanmar military and their subordinate battalions. The National Unity Government (NUG) welcomes and supports all efforts to prosecute these crimes in international courts to ensure appropriate punishment for the perpetrators and justice for the victims.
2. The mass atrocities committed against the Rohingya in 2017 were carried out solely by the Myanmar military under the leadership of Min Aung Hlaing, as per Article 20(b) and (c) of the 2008 Constitution, which was in effect at the time. Therefore, those who must be held fully accountable for these crimes without exception are Min Aung Hlaing and his associates. As such, the NUG welcomes the legal action taken by the UK-based Burmese Rohingya Organisation UK (BROUK) in the Argentine court to prosecute and issue arrest warrants against Min Aung Hlaing and his accomplices.
3. However, we strongly consider the Argentine court’s attempt to include former President U Htin Kyaw and the incumbent State Counsellor Daw Aung San Suu Kyi in the list of perpetrators—alongside Min Aung Hlaing and his associates, who are the actual perpetrators of genocide and war crimes—as a misguided and erroneous legal accusation. Therefore, we call for removal of their names from the prosecution.
4. The former President U Htin Kyaw and State Counsellor Daw Aung San Suu Kyi made various efforts to find a long-term solution to the Rohingya issue, including the establishment of the “Kofi Annan Commission.”
5. Similarly, the National Unity Government (NUG) has also established a “Rohingya Policy” and is steadfastly working to ensure justice for the Rohingya people.
6. Given these circumstances, the inclusion of State Counsellor Daw Aung San Suu Kyi and former President U Htin Kyaw in the case filed at the Argentine court may create misunderstandings between the Rohingya community and other ethnic groups. This could hinder long-term peace, reconciliation, and Myanmar’s democratic transition.
7. Therefore, the Argentine court’s attempt to prosecute and issue arrest warrants against civilian government leaders will undermine national unity among the people of Myanmar and obstruct the ongoing Spring Revolution, which is relentlessly fighting to bring an end to military dictatorship, and will ultimately benefit the terrorist military council.
